1. Scope and Who We Are

This Privacy Policy explains how Fusin ("Fusin," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information when you use fusin.ai, our web applications, APIs, image-processing services, customer support, and related products and services (collectively, the "Services").

Fusin provides software and related services for real-estate photography and image processing, including AI-assisted image enhancement, editing, quality control, and optional human review. This Policy applies to account holders, website visitors, prospective customers, and individuals whose personal information may be contained in content submitted to the Services.

Depending on the context, Fusin may act as a business/controller responsible for personal information (for example, account and billing information) or as a service provider/processor acting on behalf of a business customer (for example, when processing images uploaded by that customer).

2. Information We Collect

We may collect the following categories of information:

Account and profile information. Name, email address, company name, authentication identifiers, account settings, plan, credit balance, and similar account information.

Customer Content. Photos, RAW files, bracketed exposures, processed images, masks, revision instructions, project names, property information, filenames, metadata, and other content you upload or submit. Image files may contain embedded metadata, addresses, people, vehicles, artwork, family photographs, or other information visible in a property.

Transaction information. Subscription level, purchases, invoices, credit usage, payment status, billing details, and transaction identifiers. Payment card information may be collected directly by our payment processor rather than stored by Fusin.

Device and usage information. IP address, browser and device type, operating system, timestamps, pages or features used, upload and processing events, performance data, logs, crash data, and security-related information.

Communications and support information. Messages you send to support, feedback, revision requests, survey responses, and other communications.

Cookies and similar technologies. We may use cookies, local storage, pixels, SDKs, and similar technologies for authentication, security, preferences, analytics, and service operation.

Information from third parties. We may receive information from authentication providers, payment processors, analytics providers, integrations you authorize, referral partners, and other service providers.

Support chat. Fusin runs its own support chat, and your conversations are stored on our systems rather than a third party's. An automated assistant may answer first. When it does, we share your message, the recent conversation and details of your own account that are relevant to your question with service providers who help us answer, including providers of AI services. We never share another customer's information, and we do not share your photographs. You can ask for a person at any time, and we keep support conversations so we can answer follow-up questions and improve our answers.

3. How We Use Information

We may use personal information to:

provide, operate, maintain, and improve the Services;

authenticate users and manage accounts, plans, subscriptions, credits, and transactions;

receive, store, process, edit, render, review, and deliver Customer Content;

provide customer support, revisions, quality assurance, and troubleshooting;

personalize settings and improve workflow performance;

develop, train, test, evaluate, and improve Fusin models, algorithms, features, and services as described below;

detect fraud, abuse, security incidents, technical problems, and violations of our Terms;

measure usage, reliability, performance, and customer experience;

communicate service notices, billing information, security alerts, product updates, and marketing where permitted by law;

comply with legal obligations and enforce our agreements; and

establish, exercise, or defend legal claims.

Where applicable law requires a particular legal basis, we rely on consent, performance of a contract, compliance with legal obligations, protection of legitimate interests, or another lawful basis available under applicable law.

4. AI Processing, Model Improvement, and Derived Data

Fusin uses automated systems, including machine-learning and artificial-intelligence systems, to process Customer Content. Processing may include image alignment, enhancement, color and tone adjustment, segmentation, object or region detection, perspective correction, quality control, revision analysis, and related functions.

Unless your plan, written agreement, or enterprise terms say otherwise, Fusin may use Customer Content and outputs submitted to or produced through the Services to develop, train, fine-tune, test, evaluate, validate, and improve Fusin's models, systems, and Services, and to create technical derivatives and derived information for those purposes.

Where required by applicable law, we will obtain consent or provide applicable rights to object, withdraw consent, or opt out. Fusin may also create aggregated, de-identified, or anonymised information that does not reasonably identify an individual and may use and retain it for analytics, research, benchmarking, product development, partnerships, and other lawful purposes. Improvements already made to a model are part of that model and cannot be separated from it afterwards, so deletion stops future use rather than undoing past use.

5. Human Review and Contractors

Some Customer Content may be accessed by authorized Fusin personnel or contracted service providers when reasonably necessary for customer-requested revisions, human-in-the-loop editing, quality assurance, model evaluation, support, security, abuse prevention, or service improvement.

We limit access based on role and operational need and require service providers and contractors to handle information under confidentiality, security, and data-protection obligations appropriate to their work.

6. How We Disclose Information

We may disclose personal information to:

Service providers and subprocessors. Providers that support cloud computing, storage, content delivery, authentication, payments, analytics, communications, customer support, security, monitoring, and technical operations.

Support chat. Fusin uses a third-party support-messaging provider to run the chat widget on our website and in the Services. When you open a chat we share the account name, email address and workspace associated with your session so the conversation reaches the right record, and the provider processes whatever you choose to write in it.

Authorized contractors. Human editors, quality reviewers, engineers, or other contractors who require limited access to perform work for Fusin.

Business customers and authorized users. If you use the Services through a company, team, or organization, administrators and authorized users of that organization may access account or project information consistent with their permissions.

Professional advisers. Lawyers, accountants, insurers, auditors, and similar advisers where reasonably necessary.

Authorities and legal recipients. Government authorities, regulators, courts, law enforcement, or other parties where disclosure is required or permitted by law, or reasonably necessary to protect rights, safety, security, and the integrity of the Services.

Corporate transactions. A buyer, investor, lender, affiliate, or other relevant party in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, subject to appropriate safeguards.

We do not sell personal information for money. We do not use or disclose personal information for cross-context behavioral advertising in a manner that constitutes "selling" or "sharing" under applicable U.S. state privacy laws unless we provide any legally required notice and opt-out mechanism.

7. International Processing and Transfers

Fusin and its service providers may process or store information in Canada, the United States, or other countries where we or our providers operate. As a result, information may be subject to the laws of those jurisdictions and may be accessible to courts, law-enforcement agencies, or national-security authorities where legally required.

Where applicable law requires safeguards for international transfers, we use appropriate contractual, organizational, or other approved transfer mechanisms.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing the Services, maintaining business and transaction records, resolving disputes, enforcing agreements, improving security and reliability, and meeting legal obligations.

Retention periods vary by data type and account status. Uploaded originals are kept for a limited window after processing — currently about fourteen days — so that revisions can be carried out, after which they are removed from active storage. Processed images remain available in your account. Backups, logs, and derived information may persist for longer under our ordinary retention and disaster-recovery practices.

Aggregated, de-identified, anonymized, or model-related information that no longer reasonably identifies an individual may be retained for longer periods as permitted by law.

9. Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, theft, misuse, disclosure, alteration, or destruction. Measures may include encryption in transit and at rest where appropriate, access controls, authentication, least-privilege permissions, logging, monitoring, network and application security controls, secure software-development practices, backups, and incident-response procedures.

No system is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us if you believe your account or Customer Content has been compromised.

10. Your Choices and Privacy Rights

Depending on where you live and subject to legal exceptions, you may have rights to:

request access to personal information we hold about you;

request correction of inaccurate or incomplete information;

request deletion of certain information;

withdraw consent where processing is based on consent;

object to or restrict certain processing;

request a portable copy of certain information;

opt out of certain marketing communications;

opt out of certain sale, sharing, targeted advertising, or profiling activities where applicable; and

complain to an applicable privacy or data-protection regulator.

To exercise a privacy right, contact us using the information in Section 19. We may need to verify your identity and authority before completing a request. If you use Fusin through a business customer and your request relates to Customer Content controlled by that customer, we may direct the request to the customer or assist the customer in responding.

11. Canadian Privacy Rights

Fusin handles personal information in accordance with applicable Canadian private-sector privacy laws, which may include the federal Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta's Personal Information Protection Act (PIPA), and substantially similar provincial laws where applicable.

Canadian privacy principles generally require accountability, identification of purposes, appropriate consent, limits on collection, use, disclosure and retention, reasonable safeguards, openness, access, correction, and a process for challenging compliance.

If a breach of security safeguards creates a legally defined real risk of significant harm, Fusin will make required reports and notifications and maintain required records in accordance with applicable law.

12. EEA, United Kingdom, and Similar Jurisdictions

If the GDPR, UK GDPR, or similar law applies, Fusin will process personal data under an applicable lawful basis. Depending on the processing activity, this may include performance of a contract, legitimate interests, consent, or compliance with legal obligations.

Where applicable, individuals may have rights of access, correction, erasure, restriction, objection, portability, and withdrawal of consent, and may lodge a complaint with their local supervisory authority.

When Fusin processes Customer Content solely on behalf of a business customer, the customer may be the controller and Fusin may be the processor. Enterprise customers may request a data processing agreement where appropriate.

13. California and Other U.S. State Privacy Notices

Residents of certain U.S. states may have additional rights under applicable state privacy laws. Depending on the law and whether Fusin meets the applicable statutory thresholds, these rights may include the right to know or access categories and specific pieces of personal information, correct inaccurate information, delete certain information, obtain a portable copy, and opt out of certain sale, sharing, targeted advertising, or profiling.

Fusin will not discriminate against you for exercising a privacy right protected by applicable law. Where legally required, authorized agents may submit requests on behalf of individuals, subject to verification.

Because Fusin's data practices and applicable legal thresholds may change, this section should be read together with the remainder of this Policy and any supplemental state-specific notice we publish.

14. Cookies and Analytics

We may use strictly necessary cookies for login, security, fraud prevention, load balancing, and core functionality. We may also use preference and analytics technologies to understand how the Services are used and to improve performance.

Our public website, and the page you see right after creating an account, use Google Analytics, a service of Google LLC, to understand how visitors find and use our website, including whether a visit from an advertisement leads to an account. Google Analytics sets cookies and receives information such as the pages you view, your approximate location, your device and browser, and how you reached our website. Google may process this information in the United States. Visitors from the European Economic Area, the United Kingdom and Switzerland do not receive these cookies. You can block these cookies in your browser or install Google's opt-out add-on at tools.google.com/dlpage/gaoptout.

Where required by law, we will request consent before using non-essential cookies or provide controls to manage them. Browser controls may also allow you to block or delete cookies, but doing so can affect functionality.

15. Children and Images Containing Other People

The Services are intended for business and professional users and are not directed to children. You must satisfy the age and authority requirements in our Terms of Service to create or control an account.

Real-estate photographs and other Customer Content may incidentally contain images or information relating to other people, including minors. The customer submitting that content is responsible for having the rights, permissions, notices, and legal basis necessary to submit and process it through Fusin. Customers should avoid submitting unnecessary sensitive personal information.

16. Third-Party Services and Links

The Services may contain links to, or integrations with, third-party products and services. Their privacy practices are governed by their own notices and agreements. Fusin is not responsible for the privacy or security practices of third parties that are not acting as our service providers.

17. SMS/Text Messaging

If you give us your mobile number and agree to receive texts from Fusin, we use it only to send the messages you asked for — your trial link, account updates, and support replies. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help.

We do not share or sell mobile phone numbers, or SMS opt-in consent data, with third parties or affiliates for marketing or promotional purposes. Mobile information is shared only with the service providers that deliver the messages on our behalf, and they may not use it for their own marketing.

18. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, data practices, legal requirements, or business operations. We will post the updated version and change the "Last updated" date. If a change materially affects your rights or how we use personal information, we will provide additional notice where required by law.
